This Privacy Policy explains how FunnelPup, Rob Coates Media, LLC, and our related products, websites, applications, platforms, tools, services, features, communities, courses, templates, automations, and support services collect, use, store, disclose, and protect personal information.

FunnelPup is a division of Rob Coates Media, LLC. In this Privacy Policy, “FunnelPup,” “we,” “us,” and “our” refer to FunnelPup and Rob Coates Media, LLC. “You” and “your” refer to visitors, users, account holders, subscribers, customers, prospects, and other individuals who interact with our Services.

“Services” refers to the FunnelPup platform and any related websites, software, digital tools, templates, communities, courses, communications, integrations, support, and services we provide.

By accessing or using our Services, creating an account, submitting information, purchasing a subscription, starting a free trial, joining a community, using our email tools, building funnels, uploading contacts, or interacting with FunnelPup, you acknowledge that you have read and understood this Privacy Policy.

This Privacy Policy is intended to describe our privacy practices. It does not override any separate written agreement, Data Processing Addendum, Business Associate Agreement, or other signed agreement that may apply between FunnelPup and a customer.

2. Important Distinction: Our Users vs. Customer Contacts

FunnelPup is a SaaS platform that allows customers to build websites, funnels, forms, emails, automations, communities, courses, and related marketing systems.

Because of this, we may process two main categories of personal information:

A. Information We Collect About Our Own Users

This includes personal information about people who visit our website, create a FunnelPup account, subscribe to our services, purchase from us, contact support, join our communities, or otherwise interact directly with FunnelPup.

For this information, FunnelPup generally acts as the business, controller, or similar responsible party under applicable privacy laws.

B. Customer Data Processed Through the FunnelPup Platform

This includes information our customers collect from their own leads, subscribers, clients, customers, prospects, members, students, form submissions, and contacts while using FunnelPup.

For this information, our customer is generally responsible for deciding what information is collected, why it is collected, how it is used, and whether they have proper permission or legal authority to collect and use it. FunnelPup generally acts as a service provider, processor, or vendor that processes that information on behalf of the customer.

FunnelPup customers are responsible for maintaining their own privacy policies, consent practices, email compliance, SMS compliance, data permissions, and legal obligations related to their own contacts and end users.

3. Information We Collect

We may collect the following categories of personal information depending on how you interact with FunnelPup.

A. Account and Profile Information

When you create an account, subscribe, start a free trial, or use our Services, we may collect:

  • Name;
  • Business name;
  • Email address;
  • Phone number;
  • Mailing address;
  • Billing address;
  • Username;
  • Password or authentication credentials;
  • Account preferences;
  • Profile photo or avatar;

When you purchase a subscription, digital product, setup service, template, course, or other paid service, we may collect or process:

8. Customer Responsibilities

If you use FunnelPup to collect, store, upload, email, message, or otherwise process information about your own contacts, leads, customers, members, students, or subscribers, you are responsible for:

  • Providing your own privacy policy or privacy notice;
  • Obtaining required consent or having another lawful basis for processing;
  • Complying with email marketing laws, including unsubscribe requirements;
  • Complying with SMS, phone, and messaging laws where applicable;
  • Honoring opt-out and unsubscribe requests;
  • Ensuring your contact lists are lawful and permission-based;
  • Not uploading purchased, scraped, rented, or unlawfully obtained contact lists;
  • Not using FunnelPup for spam, fraud, phishing, deceptive marketing, or illegal activity;
  • Keeping your account login credentials secure;
  • Managing access by your team members and contractors;
  • Responding to privacy requests from your own customers and contacts;
  • Not collecting sensitive or regulated data unless legally permitted and supported by your agreement with FunnelPup.

FunnelPup may suspend or terminate accounts that violate our policies, applicable law, email compliance standards, platform rules, or acceptable use requirements.

9. Email Marketing, Unsubscribes, and Communications

FunnelPup may send marketing, educational, transactional, administrative, and service-related communications.

Marketing emails from FunnelPup will include a way to unsubscribe where required by law. You may opt out of marketing emails at any time. Even if you opt out of marketing emails, we may still send transactional or account-related messages, such as billing notices, account alerts, security notices, subscription updates, support responses, and service announcements.

If you use FunnelPup to send emails to your own contacts, you are responsible for ensuring your emails comply with applicable email laws, including requirements related to accurate sender information, non-deceptive subject lines, valid physical mailing addresses, and functioning unsubscribe links.

10. SMS, Phone, and Messaging Features

If FunnelPup offers SMS, phone, or messaging features, and you use those features, you are responsible for obtaining any legally required consent before sending messages or making calls.

You are also responsible for honoring opt-out requests, maintaining consent records, and complying with applicable laws and carrier rules, including rules related to marketing texts, automated messages, and promotional communications.

11. Cookies and Tracking Technologies

We and our service providers may use cookies and similar technologies to collect information about your interaction with our Services.

Types of cookies and tracking technologies may include:

  • Essential cookies required for platform functionality;
  • Security cookies used to protect accounts and prevent fraud;

FunnelPup may offer artificial intelligence, automation, content-generation, personalization, workflow, or recommendation features.

If you use AI or automation tools, information you submit may be processed to generate content, recommendations, workflows, email copy, funnel content, automation steps, or other outputs.

You are responsible for reviewing AI-generated or automated outputs before publishing, sending, or relying on them. You should not submit sensitive personal information, confidential information, regulated information, or information you do not have permission to use into AI features unless your agreement with FunnelPup specifically allows it.

We may use aggregated or de-identified information to improve product functionality, analytics, and performance. We do not use customer contact lists or customer-owned subscriber data to independently market to those contacts unless they directly interact with FunnelPup or give us permission.

13. Data Retention

We retain personal information for as long as reasonably necessary to:

  • Provide the Services;
  • Maintain your account;
  • Process payments and subscriptions;
  • Comply with legal, tax, accounting, and reporting obligations;
  • Resolve disputes;
  • Enforce agreements;
  • Maintain security;
  • Prevent fraud, spam, abuse, and unauthorized access;

Customer data stored in the platform may be deleted, exported, or retained according to your subscription plan, account settings, written agreement, platform capabilities, and applicable law.

If your request relates to information controlled by one of our customers, we may direct you to contact that customer. For example, if you received an email from a FunnelPup customer or submitted information through a customer’s funnel, website, form, course, or community, that customer may be responsible for responding to your request.

17. Appeals

Please include your name, the original request, the email address associated with the request, and why you believe our decision should be reviewed.
